What is an Authorized Economic Operator of Guatemala?

They are individuals or legal entities that, in compliance with international safety standards and the norms, requirements and obligations established in current customs legislation, other laws and internal regulations emanating from the SAT, will be considered Authorized Economic Operators, reliable, safe. and will enjoy the facilities granted by the Customs Service, in their relationship as partners.

Global customs play an important role in the administration of international trade that includes tax collection, preparation of foreign trade statistics, security of the logistics chain, trade facilitation, as well as protection of society. , environment and cultural heritage, among others.

The members of the World Customs Organization -WCO-, in 2005, adopted the WCO Regulatory Framework to Secure and Facilitate Global Trade (SAFE Framework), which currently rests on three pillars:

  • Customs Alliance – Customs
  • Customs Alliance – Companies
  • Customs Alliance – Other National and International Public Authorities

The second pillar, called Customs – Companies, aims to associate customs administrations with those private sector companies that demonstrate good practices and guarantee security in the logistics chain of international trade, recognizing companies as associated collaborators in these tasks. This gives rise to the figure of the Authorized Economic Operator -OAS-, which will enjoy facilities and benefits in customs clearance, once it meets the established requirements.

In 2010, with the need to strengthen and develop control and assurance mechanisms of the international logistics chain, the Authorized Economic Operator Unit of Guatemala.

The objective is to develop and implement a program aimed at private sector users who meet the requirements and conditions, which contribute to the security of goods and the facilitation of international trade within the framework of current legislation.

There are currently 112 actors qualified as Authorized Economic Operators in Guatemala.

What is an Authorized Economic Operator?

According to the Superintendency Resolution SAT-DSI-775-2020 “Administrative Provisions for the Qualification, Suspension or Cancellation of the Authorized Economic Operator, indicates the following:

ARTICLE 3. ABBREVIATIONS AND DEFINITIONS.

AUTHORIZED ECONOMIC OPERATOR: Individual or legal person that is part of the international foreign trade logistics chain that complies with international safety standards, requirements and obligations of current customs legislation and regulations, who voluntarily requests authorization from the SAT to enjoy the facilities and benefits granted. by the customs service.

What requirements must an actor meet to qualify as an Authorized Economic Operator?

According to the Superintendency Resolution SAT-DSI-775-2020 “Administrative Provisions for the Qualification, Suspension or Cancellation of the Authorized Economic Operator, indicates the following:ARTICLE 5. COMPLIANCE GUIDELINES. In accordance with the requirements established in CAUCA and RECAUCA, the SAT establishes the following guidelines for qualification as an OAS:

  1. Three consecutive years, prior to the presentation of the request for authorization as an AEO by the interested party, on issues related to compliance with customs operations before the SAT;
  2. To demonstrate sufficient financial availability to meet its commitments in accordance with the nature and characteristic of the type of economic activity carried out, the interested actor must present a copy of the financial statements for the last three years, prior to submitting the application to qualify as OAS. These financial statements must be audited by an external entity or independent professional. If the interested party is a governmental, autonomous or semi-autonomous entity, they must attach or present a copy of the technical opinion issued by the Comptroller General of Accounts of the financial statements of the audited government entity corresponding to the last three years. To define the ratios by which the financial solvency of the interested actor will be evaluated, financial indicators must be used;
  3. To demonstrate compliance with the tax and customs legal framework, not have an indictment issued against you or convictions for tax, customs, money laundering, intellectual property or other crimes against public administration and/or crimes against the administration of justice. , during the last three years, prior to the submission of the application. If it is a legal entity, it applies to its legal representatives. Likewise, you must be up to date in the fulfillment of your formal tax duties and have paid the liquid and payable tax debts; and,
  4. To demonstrate compliance with administrative management and appropriate security and protection measures in relation to cargo, personnel, interested parties, IT, transportation, facilities, as well as training and awareness of personnel; must have a control and security management system, documented in accordance with the procedure issued by the Customs Administration.

To determine compliance with the guidelines established in paragraphs a), b) and c) of this article, the Customs Administration will request information from related agencies inside or outside the SAT, by any means.

How long does the authorization as an Authorized Economic Operator last?

According to the Superintendency Resolution SAT-DSI-775-2020 “Administrative Provisions for the Qualification, Suspension or Cancellation of the Authorized Economic Operator, indicates the following:

ARTICLE 12. PERIOD OF ENABLEMENT OF THE AEO. The term of qualification as an OAS It will be indefinite, as long as the authorized AEO complies with the presentation of the annual self-assessment, maintain compliance with the requirements that gave rise to its authorization and comply with the obligations that correspond to it as an AEO.

What facilities does the Authorized Economic Operator Program provide to authorized actors?

According to the Superintendency Resolution SAT-DSI-775-2020 “Administrative Provisions for the Qualification, Suspension or Cancellation of the Authorized Economic Operator, indicates the following:

ARTICLE 20. FACILITIES.  In order to promote trade facilitation measures, the SAT, in addition to the facilities established in CAUCA and RECAUCA, will grant the AEOs those that apply to it as an actor in the international logistics chain of goods, within the following:

  1. Agile management by the SAT in operational and administrative processes, as long as the authorized AEO complies with due process;
  2. Possibility of being recognized as an AEO by the customs services of other countries, which have similar programs with which mutual recognition has been signed;
  3. Right to receive specialized training on the subject of logistics chain security, international trade and customs issues from the SAT;
  4. Special measures in situations of computer problems of SAT systems in ports, airports and borders;
  5. In cases where conditions and infrastructure allow it in primary areas, have exclusive lanes for the clearance of imports or exports; and,
  6. Others that the SAT establishes through a resolution of the Customs Superintendent.

Who can be qualified as Authorized Economic Operators?

In accordance with the Central American Uniform Customs Regulations (RECAUCA) to be qualified as an Authorized Economic Operator, it must comply with the following:Article 163. Requirements.

In addition to the general requirements established in article 56 and the presentation of documents indicated in article 59 of this Regulation, the applicant must comply with the following:

  1. Have at least three years of operations in international trade in the State Party;
  2. Count on sufficient financial availability to meet its commitments according to the nature and characteristics of the type of economic activity carried out;
  3. Demonstrated compliance with the legal, tax and customs framework for three consecutive years, The history provided by the competent authorities of the company's country of origin may be used as a reference.
  4. Have an adequate administrative management system and records of your commercial operations that allow customs services controls to be carried out; and,
  5. Have adequate safety and protection measures in relation to the cargo, personnel, business partners, IT, transportation, facilities, as well as staff training and awareness.
